These Terms of Service ("Terms") are an agreement between you and Vogata. They govern your access to and use of the Vogata website at vogata.app, the application at app.vogata.app, and everything we offer through them (together, the "Service"). We've tried to write them like humans, not lawyers.
By creating an account or using the Service, you agree to these Terms. If you're agreeing on behalf of a company or team, you confirm you have the authority to bind that organization, and "you" means that organization. If you don't agree, please don't use the Service.
Who we are
"Vogata", "we", "us", and "our" refer to the operator of the Service: Cristian Andrés Olivares Vásquez E.I.R.L., RUT 76.709.713-1, with registered address at Av. Apoquindo 5559, Las Condes, Santiago, Chile. Vogata is an ultralight performance and growth platform built for startups without a dedicated HR team. Questions about these Terms? Your account
To use most of Vogata you need an account. You agree to provide accurate information, keep your credentials secure, and take responsibility for activity under your account. Tell us right away at [email protected] if you suspect unauthorized use.
Vogata is a shared workspace. If your organization created the account, an administrator there controls access, roles, and most of the content, and can add or remove members, including you. You must be at least 16 years old to use the Service.
Acceptable use
We keep this short: use Vogata for its purpose, and don't abuse it. You agree not to:
- Break the law, infringe others' rights, or upload content you don't have the right to share.
- Attempt to access accounts, data, or systems that aren't yours, or probe, scan, or test our security without permission.
- Interfere with or disrupt the Service, including overloading, scraping at scale, or circumventing rate limits and protections.
- Reverse engineer, resell, or build a competing product from the Service, except where the law expressly allows it.
- Use the Service to harass, defame, or harm others, or to store malicious code.
If you break these rules, we may suspend or close your access to protect the Service and other users.
Your content
You and your organization own the goals, 1:1 notes, agendas, and other content you put into Vogata ("Your Content"). We don't claim ownership of it.
You grant us a limited license to host, store, process, and display Your Content for the sole purpose of operating and improving the Service for you, including generating AI assistance at your request. We do not sell Your Content, and we never use it to train AI models. How we handle data in detail is described in our Privacy Policy, which is part of these Terms.
The AI coach
Vogata includes an AI coach that helps you write clearer goals, prepare better 1:1s, and reflect on growth. It is an assistant, not a decision-maker: it never makes employment decisions, and a human is always in the loop. AI output can be wrong or incomplete, so review it before you rely on it. You are responsible for the decisions you make using the Service.
Google and Microsoft accounts, and calendars
If you choose to sign in with Google or Microsoft, or to connect Google Calendar or your Outlook calendar, you authorize Vogata to access the specific information you approve on the provider's consent screen, only to provide the related features (signing you in and managing the 1:1 calendar events Vogata creates on your behalf). Vogata's use of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements. You can disconnect Google or Microsoft access at any time from your account settings or from your account permissions with the provider.
Plans, trials, and payment
Vogata offers a free plan and paid plans. Some plans include a time-limited trial. Paid features, limits, and prices are described at vogata.app/pricing and may change over time; we'll give reasonable notice of material changes that affect you. Fees are charged in advance for the billing period you choose and, except where the law requires otherwise, are non-refundable. If a payment fails or a trial ends without an upgrade, paid features may be paused or limited.
Service availability and changes
We work to keep Vogata reliable, but we don't promise it will be uninterrupted or error-free. We may add, change, or remove features, and we may run maintenance that briefly affects availability. If we plan a change that materially reduces the Service, we'll try to let you know in advance.
Cancellation and termination
You can stop using Vogata and close your account at any time. Your organization administrator can also remove your access. We may suspend or end access if you violate these Terms, if required by law, or if continuing would create risk for the Service or other users.
When an account closes, we handle the data as described in our Privacy Policy. You're responsible for exporting anything you want to keep before closing.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent the law allows. Vogata supports your performance and growth process; it doesn't replace your own professional judgment or legal, HR, or financial advice.
Limitation of liability
To the fullest extent permitted by law, Vogata will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or USD 100. Some jurisdictions don't allow certain limits, so parts of this section may not apply to you.
Indemnity
If your use of the Service or Your Content causes a claim against Vogata by a third party, you agree to defend and indemnify us for the reasonable costs and damages of that claim, except to the extent it results from our own breach of these Terms.
Governing law and jurisdiction
These Terms are governed by the laws of Chile. Any dispute relating to them or to the Service is submitted to the ordinary courts of Santiago, Chile, without prejudice to any rights the law grants you as a consumer or data subject.
Changes to these Terms
We may update these Terms as the product and the law evolve. When we make a material change, we'll update the date at the top and, where appropriate, let you know by email or in the app. Continuing to use Vogata after a change means you accept the updated Terms.
